The Party Wall Process!
The Party Wall etc. Act 1996 provides a statutory framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations in proximity of neighbouring buildings.
How it Works for Building Owner's:

1) Serve Notice(s) on Adjoining Owner(s)
Carrying Out Works to the Party Wall, Boundary Wall and Excavating within 3/6m of the Adjoining Owners buildings require the Building Owner to serve Notices Under the Party Wall Act. These notices are best drafted by an expert Party Wall Surveyor and we can do these for you.

2) Do the Adjoining Owners Consent/Dissent to the notice Served?
When Notices are served the Adjoining Owners will have the option to dissent or consent depending on whether they agree or not.

3) Appoint a Building Owner’s Surveyor or Agreed Surveyor
Should your neighbor dissent they will have to either appoint their own Surveyor or alternatively both parties can agree on the appointment of one Agreed Surveyor. The cost of the Agreed Surveyor or the Two Surveyors is to be met by the Building Owner who is going to carry out the works. Party Wall Awards must be in place to legally commence works.

4) The Surveyor/Surveyor(s) will obtain access to your neighbours premises and carry out a Schedule of Condition of their property
This will contain photographs and a report on the condition and any existing defects of the premises. The purpose of this schedule is to protect the neighbor from any damage which is occasioned by the works and set a benchmark of the condition the property would have to be returned to in the unlikely event of damage and also to protect the Building Owner from having any pre-existing damage attributed to the Building Owner's works.

5) The Surveyor/Surveyor(s) will negotiate and after liaising with other professionals on the project, Draft and Agree a Party Wall Award.
The Surveyors will Draft a Party Wall Award and include obligations upon the Building Owner and include safeguarding measures which will protect both parties and set out conditions under which the works must commence.
6) Works can commence.
Once the initial notice period has passed or been waived the Party Wall works can then take place!
